Petitioner apprehends his arrest in connection with Sultanganj P.S.Case No. 50 of 2018 registered for the offences punishable under Sections 147, 149, 323, 354B, 307 and 379 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant, causing injury.

Submission of learned counsel for the petitioner is that there is general and omnibus allegation of assault against the petitioner and there is case and counter case between the parties and injuries were found to be simple in nature. Further submission is that the other allegations for the offences under Sections 354B and 379 IPC are ornamental in nature.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his

No.42166 of 2018 (3) dt.09-08-2018 2/2 arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Bhagalpur, in connection with Sultanganj P.S.Case No. 50 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
