====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 21-01-2026 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant.
2. The petitioner is in custody in a case registered for the offence punishable under Section 420, 467, 468, 471, 472 and 34 of the Indian Penal Code.
3. As per allegation in the FIR, it is a case of fraud where petitioner is claiming himself as the son of the informant, while the informant has out rightly rejected it by stating that he has only one son, namely, Jitendra Singh who has been serving in the Indian Army's EME Department since 2003.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the case as informant himself appeared in Army Office and submitted all the
Patna High Court CR. MISC. No.73580 of 2025(3) dt.21-01-2026 2/3 documents for inclusion of name of the petitioner. He further submits that in order to escape from the criminal liability, informant has filed this FIR and tried to make this petitioner as scapegoat. He further submits that at no stage, petitioner was anywhere involved in this entire matter. Petitioner has got clean antecedent as stated in para-3 of the petition and he is custody since 01.09.2025. He further submits that the daughter of informant, who is Bhabhi of petitioner has filed complaint case No. 722C of 2022 against one Radha Krishna Singh and others for their fraudulent act of cheating.
5. Learned APP for the State as well as learned counsel for the informant have vehemently opposed the prayer for bail of the petitioner.
6. In view of the aforesaid facts and circumstances of the case as also the facts that the informant was found to have orchestrated everything including submission of documents to Indian Army for adding the name of petitioner and subsequently was arrested by police and has been enlarged on bail vide order dated 04.08.2025 by learned Chief Judicial Magistrate. Buxar as stated in para-9 of the petition, so let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount
Patna High Court CR. MISC. No.73580 of 2025(3) dt.21-01-2026 3/3 each to the satisfaction of learned CJM, Buxar in connection with Dumraon P.S. Case No. 479 of 2022.
