2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 127(6), 137(2), 61(2) of B.N.S and sections 8, 12 and 4 of the POCSO Act and Sections 3, 4 and 5 of the Immoral Trafficking Act.

3. The case of the prosecution is that the police had secret information that in a restaurant cum guest house, the owner of the said premise Gautam Kumar is indulged in immoral trafficking act and on this information, the said premise was raided and from there, certain minor boys and girls were recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned

No.75278 of 2025(2) dt.19-11-2025 2/2 counsel for the petitioner has submitted that in the FIR, he has been shown as a manager of the said premise but actually, all the activities of the said premise are conducted by the owner. It has also been submitted that the petitioner has newly joined the assignment and he was having no knowledge regarding the illegal activities being conducted there. Moreover, the petitioner is languishing in judicial custody since 24.07.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Paliganj P.S. Case No. 362 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-VII-cum-Exclusive Special Judge POCSO, Patna.
