For the Petitioner/s :
Mrs. Sucheta Yadav For the Respondent/s :
Mr.Ansay Bahadur Mathur For the State : Mr. Fakhruddin Ali Ahmad, AC to AAG 12 ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 02-01-2019 Heard both sides.
The petitioners have filed this petition for initiating contempt proceeding against the respondents for non compliance of the order dated 22.02.2018 passed in CWJC No. 13550 of 2015 by which the petitioners were directed to file representation before the competent authority with regard to non payment of any part of compensation and the authority was directed to dispose of the representation within three months from the date of production of the order.
A show cause has been filed stating that the answering respondent has sent the representation of the petitioners before the competent authority under the Act under Section 3H (4) of the N.H. Act, 1956 as there is dispute of title between
Patna High Court MJC No.2300 of 2018(4) dt.02-01-2019 2/2 petitioners and Ramanand Prasad and the Land Acquisition Authority is not competent to decide the question of title. Taking into consideration the facts that representation of the petitioners has already been disposed of and the respondents have not violated any order of this court, I do not find any merit in this contempt petition and the same is dismissed.
