1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 448, 323, 379, 307, 504 and 506 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case by the informant.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and rebuts the aforesaid submission of the learned counsel for the petitioner and submits that there is direct allegation against this petitioner of assaulting the informant by an iron rod causing injury on his head. Learned A.P.P. further submits that the injury report has been received and from perusal of the same, it would manifest that the injury
Patna High Court CR. MISC. No.75826 of 2023(4) dt.27-03-2024 2/2 is on vital part of the body i.e. head and the opinion has been reserved which amply demonstrates that the injury was not simple.
5. Considering the submissions made by the learned A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner in connection with Gaurichak P.S. Case No. 249 of 2023 pending in the Court of learned Additional Chief Judicial Magistrate-IV, Patna City, Patna/successor Court.
