Petitioner apprehends her arrest in connection with Muffasil (Lakhaura) P.S.Case No. 79 of 2018 registered for the offences punishable under Sections 406, 420 of the Indian Penal Code and Section 66 of I.T. Act Allegation against the petitioner is that informant had gone to the ATM for withdrawing money and the person standing behind him had fraudulently transferred Rs.40,000/- from the account of informant to the account of the petitioner. Submission of learned counsel for the petitioner is that as a matter of fact the informant had taken Rs.1,40,000/- and out of that Rs.40,000/- he has transferred on that day and after nine days of the occurrence the present case has been lodged against the petitioner and moreover the petitioner is a lady and she is ready to

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of her arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Muffasil (Lakhaura) P.S.Case No. 79 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
