2. The petitioner apprehends her arrest in a case instituted under Sections 96 and 3(5) of the B.N.S.
3. As per prosecution case, the minor daughter of the informant has been kidnapped by the co-accused Golu Kumar and petitioner had facilitated him in doing the offence.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. The victim girl with her free will left her parental house and went away with co-accused Golu Kumar. Petitioner has no concern with the co-accused Golu Kumar. Petitioner is a woman aged about 55 years having no criminal antecedent and she undertakes to cooperate in the
Patna High Court CR. MISC. No.72840 of 2025(2) dt.03-11-2025 2/2 investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikarhana at Dhaka, East Champaran or Successor Court in connection with Chiraiya P.S. Case No.271 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
