JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 This is an application for grant of anticipatory bail in connection with Mahila P. S. Case No. 38 of 2019, disclosing offences under Sections 420, 376, 313, 504, 506, 34 of IPC and Section 67 of I. T. Act.

Informant who happens to be major as per F.I.R. and it is said that the petitioner on the pretext of marriage has physical relationship with her, due to which, she became pregnant and later on, petitioner refused to marry with her. Further allegation is that brother of the petitioner made viral the objectionable photographs of the informant on the 'Facebook'. Submission of the learned counsel for the petitioner is that even according to the F.I.R. she appears to be consenting party and she is major and other allegation is against brother of the petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Mahila P.
