JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 01-02-2024 The grievance of the petitioner is that the investigating agency of this case, being Bihta P.S. Case No. 539 of 2023 dated 30.05.2023 registered under Section 379 Indian Penal Code, is not taking interest in the investigation. It is submitted that the petitioner has filed representation as contained in Annexure 'P/3' to the Superintendent of Police (Rural), Gandhi Maidan, Patna with a copy to the Senior Superintendent of Police, Patna and the S.H.O. of Bihta Police Station but the same has failed to draw the attention of these

2. Learned counsel further submits that an application has been filed by the petitioner under Section 156(3) Cr.P.C. which has been forwarded by the learned court to the concerned Police Station, still no action has been taken.

3. Let this matter be brought to the notice of the Senior Superintendent of Police, Patna and the Superintendent of Police, Patna (Rural) of the concerned area who will look into the grievance of the petitioner and find out as to why even after the application under Section 156(3) Cr.P.C. having been forwarded by the learned Jurisdictional Magistrate, no further action has been taken.

4. The Senior Superintendent of Police, Patna and the Superintendent of Police, Patna (Rural) shall ensure that the case in question is properly investigated from all angles and an appropriate report be submitted in the court of learned jurisdictional Magistrate within a period of four months from the date of receipt/production of a copy of this order.
