BAJANTHRI) 30-10-2024 The petitioner has assailed the rejection of interim order passed in OA No. 775/2024 on the file of the Central Administration Tribual, Patna. The petitioner Arvind Kumar was appointed as GDS (BPM) at Katauna (BO). The official respondents floated transfer policy of the GDS (BPM) on 15.07.2021. Pursuant to such transfer policy, the petitioner submitted application with request to transfer him from Katauna to Bindidih (BO)

Patna High Court CWJC No.16728 of 2024(2) dt.30-10-2024 2/3 and he was transferred on 08.10.2022. When things stood, thus, the official respondents notified the vacancies of GDS (BPM) including the post held by the petitioner if such selection and appointment process is completed, the petitioner's apprehension is that his services be dispensed from the post. This has not been appreciated by the CAT and so also the fact that the petitioner is working as GDS (BPM) from 24.09.2010. Therefore, the Tribunal has committed error in not granting interim order.

Accordingly, the concerned official respondents are hereby directed to not to fill up the post of GDS (BPM) at Bindidih (BO) and further filling up of the post of GDS (BPM) at Katauna (BO) would be subject to result of the original application filed on behalf of the petitioner, namely, OA 775 of 2024.

3. The present interim order shall continue till disposal of OA No. 775 of 2024 on the file of the Central Administrative Tribunal, Patna.

4. The present petition stands disposed of with the above observation.
