2. The petitioner apprehends his arrest in a case registered for the offences under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Amendment Act, 2012.
3. As per the prosecution story, on 03.01.2025 at 10:10 PM, P.T.C. Dharmendra Kumar, while patrolling with the Home Guard near Vishwakarma Chowk, N.H.-106 to prevent illicit liquor, received information about two persons carrying illegal Corex syrup on a red motorcycle. The suspects, Nikesh Kumar and Ravi Kumar, tried to flee but were caught. In the presence of an independent witness, the police seized 100 bottles (10 liters) of Corex cough syrup from a sack on the
Patna High Court CR. MISC. No.71956 of 2025(2) dt.15-10-2025 2/3 motorcycle. The accused stated they purchased the syrup from Sagar Kumar Sangum, a wholesale dealer from Bardha.

Learned counsel for the petitioner submits that illegal cough syrup, 100 pieces of 100 ml bottle of cough syrup, totaling to 10 liters of Corex cough syrup, which is said to have been recovered from the motorcycle during the course of checking, does not belong to the petitioner and his name has surfaced on the disclosure of one Nikesh Kumar and Ravi Kumar. The petitioner has one criminal antecedent which is akin to the present case and on the alleged date of incident, he was in Ludhiana, for earning his livelihood by doing labour work.
5. Learned APP for the State opposes the prayer for anticipatory bail application.
6. Regard being had to the submission made by the parties, taking into consideration the fact that illicit liquor has not been recovered from the conscious possession and / or premises belonging to the petitioner, accordingly, this Court is inclined to grant anticipatory bail to the petitioner.
7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with
Patna High Court CR. MISC. No.71956 of 2025(2) dt.15-10-2025 3/3 two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise-I), Saharsa, in connection with Pastpar P.S. Case No.03 of 2025 subject to the condition as laid down under Section 482(2) of the B.N.S.S., 2023.
