The petitioner is apprehending his arrest in a case for the offence registered under Sections 341, 323, 354, 379, 307, 384 and 506/34 of the IPC.
The prosecution story, in brief, is that on 05.06.2018 at about 3.30 hours, the informant was sitting in his house, in the meantime, co-accused Ather Alam and Asger Alam armed with sword alongwith their father Kalimuddin (petitioner) came and attacked on him causing hand injury and bleeding started due to which he fell down and thereafter they took Rs. 60,000/- and two pieces of gold ring from his house. They also attacked on his wife
Patna High Court Cr.Misc. No.57996 of 2018 (3) dt.08-10-2018 2/3 and co-accused Athar threatened to kill entire family if they will try to fight. The brother of the informant Majid Kausar has also got head injury. It is further alleged that the informant works in Saudi Arabia and earlier accused persons demanded Rs. 1,00,000/- from the informant.
It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to family dispute. The petitioner is alleged to be order giver. No injury is attributed against the petitioner. The main allegation is against co-accused Athar Alam and Asgar Alam. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Patna City, in connection with Alamganj P.S. Case No. 293 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of
