The petitioners apprehend their arrest in Athmalgola P.S. case No. 108 of 2019 registered under Section 307 and some other Sections of the IPC.

The informant named the petitioners and other accused persons and alleged that they all assaulted the family members of the informant and on account of assault Nitish Kumar and Kaleshwar Paswan got injuries on their heads. Laleshwar Paswan, petitioner No.1, and Raj Kumar Paswan took out Rs. 2,000/- from the pocket of the informant.

Patna High Court CR. MISC. No.70631 of 2019(3) dt.18-12-2019 2/2 The learned counsel for the petitioners submits that there is counter version being Athmalgola P.S. case No. 111 of 2019. On account of drinking liquor some verbal altercation took place between two sides and both sides engaged in mutual assault on each other. The injured, Nitish Kumar and Kaleshwar Paswan, got simple injuries.

Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Barh, Patna in connection with Athmalgola P.S. case No. 108 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
