The petitioner is apprehending his arrest in a case registered under Sections 143, 144, 145, 186, 188, 323, 333, 353, 307, 379, 506, 504 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is that the informant along with other police personnel was on special drive against illegal mining on 5.2.2018 and reached near Chandralay and started seizing the sand loaded trucks. In that course, mob of 200 to 250 persons started pelting stones against the police official and also fired on them, in which police party sustained injury. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation

Patna High Court Cr.Misc. No.53049 of 2018(2) dt.05-10-2018 2/2 of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner. Other co-accused have been granted bail vide Annexure-3 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Hajipur Sadar P.S. case No.74 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
