JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This is an application for grant of anticipatory bail in connection with connection with Salkhua P. S. Case No. 64 of 2019 arising out of Complaint Case No. 1116 of 2017, disclosing offences under Sections 341, 323, 498A, 499, 307 of IPC.

Petitioner happens to be the husband of the complainant and there is allegation that they have assaulted the complainant by fists and slaps and taken away Rs.15000/- and they have also threaten that the petitioner is going to solemnize the second marriage with another lady.

Submission of the learned counsel for the petitioner is that earlier two cases have been lodged by the complainant and

No.69427 of 2019(2) dt.05-11-2019 2/2 the petitioner is on bail and a talk of compromise was also held by the Panchayat and before Panchayati they have compromised the case and decided to live separately and a maintenance case is also filed by the complainant and maintenance amount is being paid by the petitioner to the complainant. In spite of that, he is still ready to keep her with dignity and care. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Saharsa, in connection with Salkhua P. S. Case No. 64 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
