The petitioner apprehends his arrest in connection with Hathauri P.S. Case no. 34 of 2018, registered under Sections 323, 341, 354, 379 and 504/34 of the Indian Penal Code.
The accusation is that Ram Charan Singh, father of the informant, Ashok Singh executed Will deed regarding three katha of land in favour of his step-brothers, namely, Amarjeet Singh and Santosh Singh due to that reasons on 16.03.2018, he made complaint for his share in that land then Amarjeet Singh pressed his neck, but anyhow, he managed to set free. Thereafter, Amarjeet Singh laid him on the ground and his stepmother Sunair Devi started to cause assault causing injury to
Patna High Court Cr.Misc. No.54853 of 2018(3) dt.11-12-2018 2/2 him and his sister-in-law and Rambhajan Singh, brother of step-mother Sunair Devi also caused injury through lathi. At that time, Amarjeet Singh (petitioner) stnaced the cash of Rs. 1200/- from his pocket.
Learned counsel for the petitioner submits that, admittedly, the petitioner is step-brother of the informant and due to land dispute hot talks were exchanged, but with ulterior motive the petitioner has been implicated in this case making allegation of pressing neck of the informant and snatching money from his pocket. Further submission is that, in fact, no any external injury was found on the person of the informant. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-II, Rosera, Samastipur in connection with Hathauri P.S. Case No. 34 of 2018, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
