11-09-2018 Heard Smt. Rina Sinha, learned counsel for the petitioner and Smt. Sangeeta Sharma, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Mahua P.S. Case No. 23 of 2018 registered for offence under Sections 414/34 of the Indian Penal Code and Sections 30(a), 32(ii), 41(i) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. By way of referring to statement made in paragraph - 3 of the petition, it has been argued that petitioner is having clean antecedent. Besides this, it has been argued that there is no direct accusation against the petitioner, save and except the fact that petitioner's motorcycle was parked and it was seized by the police. Even from the motorcycle, nothing was recovered.

No.53797 of 2018(3) dt.11-09-2018 2/2 In view of nature of accusation and clean antecedent of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Sonu Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II cum Special Judge, Vaishali at Hajipur in connection with Mahua P.S.
