Petitioners, who are in custody, seek bail in a case registered for the offences punishable under Sections 346, 366(A), 367, 370, 370(A), 372, 373, 376, 120(B) of the Indian Penal Code, Sections 3, 4, 5, 6, 7, and 8 of the Immoral Traffic Act, 1956, Section 4, 6, 12 and 17 of the POCSO Act, 2012 and Section 75 and 81 of the Juvenile Justice Care and Protection Act, 2015.

On the basis of written complaint of Sanju Singh to the effect that immoral traffic is going on at several places,

Patna High Court CR. MISC. No.72885 of 2019(3) dt.16-01-2020 2/3 raid was conducted at several places and during course of raid, from the house of the accused several minor and major girls were recovered along with other incriminating articles. It has been submitted on behalf of the petitioners that they are innocent and have committed no offence. They have been falsely implicated in this case. The said recovery has been made from the joint family house. Allegation against petitioners is recovery of two major girls. Similarly placed coaccused have been granted bail by co-ordinate benches of this court vide order dated 04.12.2019, 27.11.2019, 13.11.2019, 04.11.2019 and 19.11.2019 passed in Cr. Misc. No. 70878 of 2019, Cr. Misc. No. 69347 of 2019, Cr. Misc. No. 65747 of 2019, Cr. Misc. No. 65264 of 2019 and Cr. Misc. No. 71852 of 2019 respectively. They have no criminal antecedent and are in custody since 06.07.2019.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) each each with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge-cum-Special Judge (SC/ST/POCSO) Bettiah, West Champaran, in connection with Bettiah (Town) P.S. Case No.

Patna High Court CR. MISC. No.72885 of 2019(3) dt.16-01-2020 3/3 501 of 2019, subject to conditions:

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioners shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
