2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118, 329(4), 109, 303(2), 125(A), 125(B), 352, 351(1), 351(2) of the Bharatiya Nyaya Sanhita.
3. As per F.I.R., all the named accused persons, including these petitioners, assaulted informant and others by means of sharp-edged weapons. It is further alleged that the accused persons also snatched Rs. 5,000/-.
4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Due to petty dispute, altercation took place between the parties in
Patna High Court CR. MISC. No.71886 of 2025(4) dt.12-03-2026 2/2 which both sides sustained injuries. Allegation of assault is general and omnibus and there is no allegation of specific overt act against these petitioners. Injuries sustained by the injured are simple in nature. Similarly situated co-accused persons have already been granted anticipatory bail by co-ordinate Bench of this Court vide order dated 11.08.2025 passed in Cr. Misc. No. 50059 of 2025. Rest of the allegations are ornamental only to make the case grave.
5. Learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation and injuries, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Jamui P. S. Case No. 708 of 2024, subject to condition as laid down under Section 482(2) BNSS. (Prabhat Kumar Singh, J) Navya/- U T
