This is an appeal under Sections 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, against refusal of the prayer for anticipatory bail by order dated 04.08.2018 in A.B.P. No.2285 of 2018 passed by the learned A.D.J.-1st, Saran at Chapra in connection with Panapur P.S.Case No. 101 of 2018 registered under Sections 341,323,324,307,506 and 34 of the Indian Penal Code as well as under Sections 3(i)(r) of the Scheduled Castes and Scheduled Tribes Act.
According to FIR, two person allegedly attacked with dagger causing injury to the informant, when the informant was going to marry with the referred
Patna High Court CR. APP (SJ) No.3322 of 2018 dt.20-11-2018 2/2 girl. The statement of the referred girl reveals that the appellant was not liking his marriage. Hence, he might have committed the act aforesaid.
Submission is that the case dairy would reveal that there is no other eye witness of the occurrence. Considering the nature of allegation and material, interrogation of the appellant would be necessary during investigation of the case. Hence, the appellant may surrender and pray for regular bail. In my view, this is not a fit case for grant of anticipatory bail.
Accordingly, this appeal stands dismissed.
