1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 302 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.

3. Learned counsel for the petitioners, after arguing vehemently for some times realizing his difficulty, seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 1 (Manoj Paswan @ Kara Paswan @ Karu Paswan).

4. Permission is accorded.

5. It is next submitted that the informant alleges that children were fighting while playing cricket, but then dispute escalated and Manoj Paswan fired causing firearm injury to Baby Devi who died at the spot.

6. Learned counsel for the petitioner submits that petitioner no. 2 is a person with clean antecedent and is a woman and is wife of Manoj Paswan. It is next submitted that petitioner has been implicated in the instant case only to coerce Manoj Paswan into submission when specific allegation of firing is against Manoj and against petitioner no. 2, it is alleged that she also assaulted with brick and danda.

7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

8. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the fact that petitioner no. 2 is a woman, the petitioner no. 2 abovenamed, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Paraiya P.S. Case

9. Accordingly, the instant anticipatory bail application stands allowed.
