This is an appeal under Sections 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, against refusal of the prayer for anticipatory bail by order dated 01.08.2018 in A.B.P.No.169 of 2018 passed by the learned Exclusive Special Judge, SC/ST, Gaya in connection with Amas P.S.Case No.267 of 2017 registered under Sections 366 and 376(D)/34 of the Indian Penal Code as well as under Sections 3(i)(w)(ii), 2(v) of the Scheduled Castes and Scheduled Tribes Act.
Allegation against the appellant is of physical relation on pretext of marriage with the informant. Subsequent allegation is that the appellant called to the informant at Aurangabad and some others also
Patna High Court CR. APP (SJ) No.3299 of 2018 dt.20-11-2018 2/2 committed rape against her.
Considering the nature of allegation against the appellant, I am not inclined to enlarge the appellant on anticipatory bail.
Accordingly, this appeal stands dismissed.
