1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Sabour P.S. Case No. 578 of 2022 dated 21.12.2022 registered under Sections 341, 323, 307, 506 of the I.P.C.
3. As per the First Information Report the petitioner assaulted the informant and her husband with khanti due to which both of them sustained injury.
4. Learned counsel for the petitioner submits that informant is the step sister of the petitioner and there is dispute regarding partition between them. The injury caused to the informant though opined as grievous in nature by the doctor but the same is not on the vital part of the body and she has sustained injury on her right arm. Insofar injury caused to the husband of the informant is concerned, the same has been opined as simple in
Patna High Court CR. MISC. No.76007 of 2023(3) dt.07-03-2024 2/2 nature.
5. Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are closely related, there is dispute regarding partition, injury caused to the husband of the informant is simple in nature whereas the informant has sustained injury on non vital part of the body, as such, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Bhagalpur in connection with Sabour P.S. Case No. 578 of 2022 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anil Kumar Sinha, J) praful/- U T
