The petitioner seeks bail in connection with Majhauliya P.S. Case No.701 of 2020 registered for the offence under Section 30(a), 32, 41(1) of the Bihar Prohibition & Excise Act, 2016.

The recovery is of 110 litres of country made liquor from a hut.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.08.2023 and he has clean antecedent. He further submits that petitioner is ready to donate Rs.25,000/- (Rupees Twenty Five Thousand Only) in some charitable organization without accepting his guilt.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court, Excise-II, Bettiah, West Champaran, in connection with Majhauliya P.S. Case No. 701 of 2020. 6.

This is also subject to the condition that the petitioner shall deposit an amount of Rs.25,000/- (Rupees Twenty Five Thousand Only) in Ramkrishna Mission Ashrama, Muzaffarpur and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.

The petitioner shall also mark his presence in Majhauliya Police Station, West Champaran on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
