The learned counsel appearing for the petitioners seeks permission to withdraw the anticipatory bail application on behalf of the petitioner No.1 Accordingly, the present anticipatory bail application on behalf of the petitioner No.1 is to be withdrawn. However, withdrawal of the anticipatory bail application will not cause prejudice to the petitioner no.1 and in the event, the petitioner no.1 surrender before the Court below and prays for regular bail, the Court below is hereby directed to dispose of the application
Patna High Court Cr.Misc. No.53868 of 2018(3) dt.12-12-2018 2/2 for regular bail of the petitioner no.1 on the same day in accordance with law without being prejudice by this order. The remaining petitioners No.2 to 6 are apprehending their arrest in connection with Tariyani P.S. Case No. 103 of 2018 for the offence under Sections 147, 148, 149, 323, 341, 354, 379, 435, 504 I.P.C. & Section 25 (1-B) (A), 26 Arms Act. Considering the facts that there is land dispute between the parties and there is case and counter case, let the petitioners No. 2 to 6 above named, in the event of arrest or surrender within one moth from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 103 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C.
