1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 137, 96 and 3(5) of the BNS, 2023.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that victim aged about 17 years 4 months was enticed and kidnapped by the petitioner.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant, it is next submitted that the date of occurrence is 06.05.2025 and the FIR came to be instituted on 23.06.2025 i.e.

Patna High Court CR. MISC. No.71855 of 2025(2) dt.16-10-2025 2/2 after a delay of 38 days without any plausible explanation. It is next submitted that the victim came back and her statement was recorded under Section 183 BNSS wherein she has not supported the case of the prosecution, as has been recorded in the order impugned.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Singhwara P.S. Case No. 162 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.

7. Accordingly, the instant anticipatory bail application stands allowed.
