2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 188, 379, 427 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
3. At the outset, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that from bare perusal of the impugned order it is apparent that proceedings under Sections 82 and 83 of the Cr.P.C. has already been issued against these petitioners. It is further submitted that Petitioner No. 1 has got
Patna High Court CR. MISC. No.72679 of 2025(2) dt.01-11-2025 2/2 three criminal antecedents and Petitioner No. 2 has got five criminal antecedents. In this connection, reliance is placed upon recent judgment of the Hon'ble Apex Court rendered in the case of Prem Shankar Prasad versus the State of Bihar and Another reported in LL 2021 SC 579.
4. Considering the facts and circumstances of the case, criminal antecedents of the petitioners, the fact that proceedings under Sections 82 and 83 of the Cr.P.C. has already been issued against these petitioners and judgment of the Hon'ble Apex Court passed in the case of Prem Shankar Prasad (supra), the prayer for grant of anticipatory bail to the petitioners is rejected.
