Petitioner is apprehending arrest in connection with Bhagwanpur (Belaon) P.S. Case No. 91 of 2018 for the offence under sections 147, 148, 149, 323, 307, 332, 333, 353 and 427 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
Referring to FIR, he submits that petitioner has been named in the instant case on account of alleged involvement in the protest against encroachment removal. Learned counsel for the petitioner submits that 34 persons have been named in the FIR and more than 140-150
Patna High Court Cr.Misc. No.56280 of 2018(3) dt.08-10-2018 2/2 men and women were named as unknown involved in the instant case.
Considering the fact that petitioner was a member of the mob which caused hurdles in the operation of removal of incroachment, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-II, Kaimur at Bhabhua, in connection with Bhagwanpur P.S. Case No. 91 of 2018, G.R. No. 1072 of 2018 subject to the condition as laid down under section 438(2) of the Cr.P.C.
