2. The petitioner seeks bail in a case registered for the offence under Sections 103(1), 3(5) of B.N.S., 2023 and Section 27 of the Arms Act.
3. Informant suspects that at the instance of coaccused Dinesh Mahto @ Dinesh Mehta this petitioner along with Dilwa Kumar committed murder of her husband.
4. Learned counsel for the petitioner submits that informant is not an eye-witness to the occurrence. The allegation is based on suspicion. Even as per F.I.R., there was dispute between the informant and co-accused Dilwa Kumar who threatened to commit murder of the husband of the
Patna High Court CR. MISC. No.72466 of 2025(3) dt.01-12-2025 2/2 informant. Petitioner has been made accused in this case merely because he is friend of co-accused Dilwa Kumar. During investigation, no material has come to show complicity of the petitioner in the alleged occurrence. Petitioner has got clean antecedent and is in custody since 13.07.2025. Charge-sheet has been submitted.
5. Learned A.P.P. for the State opposes the prayer for bail.

Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Udakishunganj, DistrictMadhepura in connection with Udakishunganj P.S. Case No. 428/2024.
