JUSTICE SHAILENDRA SINGH ORAL ORDER 14-11-2025 This writ petition has been filed under Article 226 of the Constitution of India by the petitioner seeking the following reliefs:- "i. For issuance of the writ in the nature of Mandamus directing the Circle Officer to measure and demarcate the land appertaining to Khata No. 87, Khesra No. 368/228 Area 1.5 Decimals, Khesra No. 368/229 Area 2 Decimals and Khesra No. 402/408/229 Area-4 Decimals, situated at Thana No. 20, Mauza - Gorgama, Halka Dumriya, Anchal - Belhar, District - Banka. ii. For issuance of appropriate writ directing the Circle Officer, Belhar, to carry out proper measurement and clear demarcation of the Petitioner's land in presence of all parties, under the direct supervision of the DCLR/SDO, within a fixed timeframe.

iii. For issuance of writ in the nature of

3/4 command direction all the parties to maintain status quo over the land in question till final measurement done by the concerned authority.

iv. Issuance of any other writ/writs, order/orders for which the Petitioner is entitled to in accordance with law."

2. Mr. Ranjan Kumar Dubey, learned cousel for the petitioner and Mr. Yogendra Prasad Sinha, learned AAG-7 are present and they are heard.

The main grievance raised by the petitioner in this writ petition is that the Circle Officer, Belhar, Banka is sitting tight over the petitioner's application in which he has made a prayer for measurement and demarcation of his land in presence of all the parties and in this regard, he has filed several representations, though the petitioner received a notice dated 20.05.2023 signed by the Circle Officer directing him to be present on 14.06.2023 for measurement of the lands mentioned in the notice and a direction was also given to Anchal Amin to submit his report in the light of the details given in the notice but the said Anchal Amin with malafide intention gave his report regarding only two Khesras while there is details of more

4/4 than two Khesras in the notice (Annexure-P/4) which shows mala fide intention on the part of Anchal Amin.

This Court is of the view that the issue raised by the petitioner in this writ petition is premature for consideration, under writ jurisdiction however, the Circle Officer, Belhar, Banka is directed to decide the petitioner's application (Annexure-P/5) in an impartial manner as per the provisions of law in the next three months from the date of receipt, or production of a copy of this order.

5. With above direction this writ petition stands disposed of.
