2. The Petitioner is apprehending his arrest in a case registered for the offences punishable u/ss 353, 216, 225, 504, 427 and 120B read with 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner took shelter in the house of the co-accused, Anil Singh and the police surrounded the house of the co-accused, Anil Singh and directed the co-accused to handover the petitioner then the co-accused, Anil Singh raised alarm, thereafter, the villagers assembled there and started pelting stone on police and compelled the police force to go away from there. In the meantime, the petitioner fled away.

4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner is relative of the co-accused, Anil Singh. The covillagers got the petitioner escaped from the custody of police. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The similarly situated co-accused, Anil Singh has been granted bail by a Bench of this Court vide order dated 25.02.2023 passed in Cr. Misc. No. 65154 of 2022.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Gaya in connection with Sherghati P.S. Case No. 591 of 2022, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure, with the condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date,
Patna High Court CR. MISC. No.76469 of 2024(2) dt.15-02-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
7. The application stands allowed.
