2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1), 351(3) and 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the informant, Meena Devi, alleged that her son went with the co-accused persons and was later brutally assaulted by them, resulting in his death. This information was conveyed to the informant by a girl who was cutting grass near the place of occurrence.

4. It is the specific case of the informant that the F.I.R.-named accused persons killed her son. Petitioner is not named in the F.I.R. His name surfaced during investigation only on the confessional statement of co-accused Bachchu Jha. The only allegation against the petitioner is that he, along with coaccused Niraj Kumar Mandal, was seen dragging the deceased

Patna High Court CR. MISC. No.72425 of 2025(3) dt.01-12-2025 2/2 in the field. There is no allegation that he was seen assaulting the deceased, nor is there any allegation that he committed rape upon the deceased. The petitioner is in custody since 04.07.2025, the charge-sheet has been submitted and he claims clean antecedents.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Raghuvansh Nagar P.S.
