The petitioners apprehend their arrest in connection with Ajam Nagar P.S. Case No.32 of 2022, registered for the offences punishable under Sections 323, 363, 366, 504, 506 and 34 of the Indian Penal Code.

The petitioners in association of other co-accused is said to have abducted the daughter of the informant. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is submitted that the petitioners have got no criminal antecedents as stated in paragraph-3 of the bail

Patna High Court CR. MISC. No.73673 of 2022(2) dt.04-02-2023 2/2 application. It is further submitted that similarly situated other co-accused have already been enlarged on anticipatory bail by this Court vide order dated 29.11.2022, passed in Cr. Misc. No.44401 of 2022. Though the victim has taken the names of the petitioners in her statement recorded under Section 164 Cr.P.C., but in the FIR, no specific allegation is made against the petitioners.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners. Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Ajam Nagar P.S. Case No.32 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
