2. The petitioner seeks bail in a case registered for the offences punishable under Sections 406 and 409 of the Indian Penal Code.

3. The prosecution case, in short, is that in the Chief Minister Nal Jal Yojana, the petitioner was a contractor. It is alleged that he was given Rs.9,95,000/- but he has not performed the work of this amount.

4. Learned counsel for the petitioner has submitted that he is proprietor of Maa Enterprises. He has annexed the bill of the entire amount and has submitted that he has supplied the materials. It has further been submitted that vide Annexure-P/4,

Patna High Court CR. MISC. No.71860 of 2025(2) dt.13-10-2025 2/2 it will transpire that there is guidelines of the State Government that this work has not to be done by tender. It has also been submitted that the informant has violated the guidelines of the State Government and moreover the petitioner, who is only proprietor of Maa Enterprises, has supplied the articles for more than the amount which is alleged to have been transferred in his account. It is lastly submitted that the petitioner is in custody since 03.09.2024.

5. The learned APP has vehemently opposed the bail application.

6. Considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, East Champaran at Motihari in connection with Kundwa Chainpur P.S. Case No.76 of 2020.
