JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-04-2023 The present petition has been filed to renew the prayer for grant of bail to the petitioner which was earlier rejected vide order dated 04.12.2019 passed in Cr. Misc. No. 63817 of 2019.

In pursuance to the direction of this Court vide order dated 28.03.2023, a report with regard to the present stage of the case has been received and it has been kept at Flag-A. The report of the learned Additional District & Sessions Judge-III-cum-Special Judge, MP/MLA Cases, Gaya dated 17.04.2023 suggests that record is fixed for evidence and the trial is likely to be concluded within six months.

Patna High Court CR. MISC. No.1634 of 2023(3) dt.28-04-2023 2/2 It is submitted by learned counsel for the petitioner that petitioner is in custody since 19.06.2019 and up-till now no prosecution witness has been examined.

Considering the nature of accusation, this Court is not inclined to grant privilege of bail to the petitioner for the present. The prayer for grant of bail to the petitioner stands rejected.

The Trial Court is directed to expedite the trial and conclude the same as stipulated in the report dated 17.04.2023.

The petitioner will be at liberty to renew his prayer for bail if the trial is not concluded within a period of six months.
