The petitioner has prayed for bail in a case registered for the offence punishable under sections 323, 354(B), 354(c), 506, 498A and 34 of the Indian Penal Code.
As per allegation in the FIR, petitioner along with his other family members has tortured in various ways to the informant due to non-fulfillment of additional dowry demand. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is husband of the informant and he has been falsely implicated in this case. He has never demanded any thing from the informant. In fact, informant was wedded
Patna High Court CR. MISC. No.75984 of 2023(2) dt.01-12-2023 2/2 wife of one Jawed Akhtar and after hiding the fact, she solemnized second marriage with the petitioner. Earlier, petitioner has filed Matrimonial Case No. 374 of 2023, which is pending before the concerned family court. Petitioner has got no criminal antecedent and languishing in judicial custody since 24.7.2023.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara in connection with Mahila PS Case No. 54 of 2021.
