The petitioner apprehends his arrest in connection with Kochas P.S. Case No.157 of 2022, registered for the offences punishable under Sections 8(c)/20(b)(ii)(B)/29 of the N.D.P.S. Act.

The police recovered 1.8 kg. Ganja from the shop of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is no compliance of Section 50 of the N.D.P.S. Act and Section 100 of the Cr.P.C. Learned APP for the State opposed the prayer for

Patna High Court CR. MISC. No.73661 of 2022(2) dt.04-02-2023 2/2 grant of anticipatory bail to the petitioner by submitting that Ganja was recovered from the shop of the petitioner. Considering the nature of offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected.
