Petitioner seeks bail in a case registered for the offences punishable under Sections 364 and 302/34 of the Indian Penal Code.
This is a case of misuse of privilege of bail. Petitioner is in custody since last eleven months after arrest. Submission is that the petitioner undertakes to not to commit further misuse of privilege of bail.
Considering the aforesaid undertaking of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 300 of 2002 arising out of Basantpur
Patna High Court CR. MISC. No.76273 of 2019(4) dt.05-03-2020 2/2 Police Station Case No. 81 of 2001, subject to the following conditions:- (a) That if the petitioner would again misuse the privilege, the learned court below would be at liberty to conclude the trial keeping the petitioner behind the bar. (b) That the petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) That both the bailors shall be resident of the territorial jurisdiction of the learned court below.
