2. The petitioner seeks bail in connection with Hariharnath P.S. Case No. 80 of 2025 instituted for the offences under Sections 303(2), 317(2), 317(5), 3(5) of the Bharatiya Nyaya Sanhita.

3. The prosecution case, in short, is that during evening patrolling on 15.07.2025, police caught three persons cutting a stolen boat with a gas cutter near Aanandpur Ghat. On interrogation, they revealed that the boat was stolen from Doriganj and belonged to one Lal Mohan Rai.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. No

Learned counsel further submitted that petitioner has got no concern with the boat in question. Learned counsel further submitted that, as a matter of fact, petitioner is a mechanic and one of the boat partner had called him to repair the boat. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.07.2025 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Hariharnath P.S. Case No. 80 of 2025.
