====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Chandi (Bena) P.S. Case No. 208 of 2018 registered under Section 302/34 of the Indian Penal Code.

The accusation is that in the evening of 15.07.2018, the daughter of the informant was not seen at the house, upon which, informant, Ashok Manjhi @ Gumani Manjhi (petitioner) along with his brother Bijendra Manjhi started to search his daughter, who was found in injured condition in the field of Kedar Singh, but on query, she did not disclose anything and her voice was not clear due to injury. Thereafter, informant, Ashok Manjhi (petitioner) rushed for treatment of his daughter, but she died in the way. The informant raised suspicion about causing

Learned counsel for the petitioner submits that, in fact, on the basis of written report of petitioner, Chandi (Bena) P.S. Case No. 208 of 2018 was instituted on 16.07.2018, under Section 302/34 of the Indian Penal Code but in collusion with the accused named in the F.I.R., police got implicated the petitioner, who is informant in this case, showing his confessional statement indulging in the killing of his daughter, which is detailed in paragraph 36 of the case diary. It is further submitted that petitioner has no criminal antecedent and is in custody since 19.07.2018.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Hilsa, in connection with Chandi (Bena) P.S.
