2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The petitioner is apprehending his arrest in connection with Bela P.S. Case No. 186 of 2023 dated 04.08.2023 registered for the offences punishable under Sections 406, 419 and 420/34 of the I.P.C.

4. As per the prosecution case, the petitioner and the co-accused Umesh Sahni took Rs. 2,50,00/- each from the informant and three other persons to go to Libia country

Patna High Court CR. MISC. No.75482 of 2023(2) dt.11-12-2023 2/3 for their livelihood but they were sent to Dubai country in place of Libia country. Thereafter, the informant and other persons returned to India. Thereafter, the informant and others demanded their money from the petitioner, upon which, the petitioner and the co-accused Nandan Sahni abused and ousted them from their house.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. The petitioner and the informant are the residents of the same village and the petitioner is a simply educated person and working in a private company in New Delhi and the said company works for Air Ticketing, Visa and job placement in foreign country. So, the informant himself contacted with the petitioner for his placement in the foreign country. The informant introduced him before the said company. The petitioner had no knowledge about the alleged incident. Suddenly, the aforesaid incident came to the knowledge of the petitioner. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application.

6. Learned A.P.P. for the State has opposed the

Patna High Court CR. MISC. No.75482 of 2023(2) dt.11-12-2023 3/3 prayer for anticipatory bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court concerned, Sitamarhi, in connection with Bela P.S. Case No. 186 of 2023, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

8. The application stands allowed.
