====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-01-2025 Heard Mr. Manoj Kumar Pandey, learned counsel appearing on behalf of the petitioners and Mr. Uma Shankar Prasad Singh, learned A.P.P. for the State.

2. At the outset, learned counsel appearing on behalf of the petitioners informs that petitioner no. 1, namely Prakash Kumar @ Prakash Paswan, has been arrested during the pendency of the present modification application and seeks to withdraw the present modification application on behalf of petitioner no. 1.

3. Permission is accorded.

4. The petitioner no. 2, namely, Subodh Paswan, seeks modification of the order dated 21.08.2024 passed in Cr. Misc.

Patna High Court CR. MISC. No.77803 of 2024(2) dt.24-01-2025 2/2 No. 51310 of 2024 for further extension of time to surrender before the learned District Court.

5. Considering the above facts and circumstances of the case, as well as, the fact that the petitioner no. 2, has shown his willingness that he will deposit a sum of Rs. 2500/- into the account of Advocates' Association of Patna High Court and also considering the reasons assigned in the modification application and the affidavit, further period to surrender before the learned District Court is extended for four weeks from the date of communication of this order.

6. Accordingly, the modification application stands disposed of.
