The petitioner has prayed for bail in a case registered for the offence punishable under sections 393, 307/34 of the Indian Penal Code and section 27 of the Arms Act. Prosecution case relates to robbery of a bag containing Rs. 1,50,000/- from the informant It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. No one is the eye witness of the alleged occurrence. His name transpired in this case on the basis of confessional statement of co-accused Prakash Kumar, which has no evidentiary value in the eye of law. Nothing has been recovered from possession of the petitioner. Petitioner is languishing in judicial custody since

The application for bail is opposed by learned APP for the State and submitted that petitioner has got two criminal antecedents.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 3rd, Jamui in connection with Jamui P.S. Case No. 315 of 2022.
