The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 326, 307 of the Indian Penal Code.

As per allegation in the FIR, petitioner is husband of the informant and over a minor dispute scuffle took place between the husband and wife. Husband assaulted her wife by knife as a result of which she received cut injury over her hand and neck.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. After prevailing good sense the matter has been compromised between the parties and the compromise petition is annexed as

Patna High Court CR. MISC. No.74444 of 2022(2) dt.27-03-2023 2/2 Annexure-2 to the supplementary affidavit filed on behalf of the petitioner. Petitioner is languishing in judicial custody since 4.09.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st Siwan in connection with Maharajganj P.S. Case No. 263 of 2022.
