Petitioner apprehends arrest in Mahila PS Case No. 138 of 2018 registered under Sections 498A, 420, 34 of the IPC and Sections 3⁄4 of the Dowry Prohibition Act. It is submitted by Counsel for the petitioner that the informant has been implicating the petitioner in cases involving such grave allegation since before. Earlier also he was made accused in Sessions Trial No. 1792 of 2007 (Annexure 2) wherein allegation under Sections 498 and 376 IPC were levelled against the petitioner in which he has been acquitted on 10.4.2018. He submits that instant case is one amongst series of false allegations made against the petitioner.

Patna High Court Cr.Misc. No.75667 of 2018(2) dt.19-12-2018 2/2 Considering the aforesaid submissions as also the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of his arrest or surrender before the court below within four weeks from today, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Priya Shekhar, Judicial Magistrate, lst Class, Patna in Mahila PS Case No. 138 of 2018 subject to all conditions as laid down in Section 438(2) of the Criminal Procedure Code.
