2. Learned counsel for the appellants submits that

Patna High Court FA No.118 of 2023(2) dt.12-07-2024 2/2 valuation of suit and appeal is Rs. 50,000/- which is less than Rs. 10,00,000/-, accordingly first appeal is required to be filed before learned District Judge, Samastipur, and accordingly, he seeks permission to withdraw this appeal with liberty to file the First Appeal before the said court.

3. Permission is accorded.

4. Accordingly, F.A. No. 118 of 2023 is dismissed as withdrawn with permission as prayed for.
