JUSTICE SANDEEP KUMAR ORAL ORDER 16-08-2023 This is an application for quashing of the order dated 07.03.2022 passed by the learned Addl. District & Sessions Judge-I-cum-Special Judge, Kaimur at Bhabhua in NDPS Case No. 05 of 2015 arising out of Kuchhila P.S. Case No. 08 of 2015 by which the learned Court has rejected the petitioner seeking release of the property of the petitioner attached in order to compel his appearance in the present case.
2. As per the prosecution case, the informant got secret information that one Ranjan Kumar is farming the opium crops and he proceeded with police party and found opium having culivated on 3 1⁄2 Acre of land opium crop and on query the villagers informed that the crops belongs to one Ranjan Kumar.
3. The petitioner has filed an application for release of the articles which were seized pursuant to the process issued
Patna High Court CR. MISC. No.1379 of 2023(2) dt.16-08-2023 2/2 under Section 83 Cr.P.C.
4. Now the petitioner has surrendered and he is on bail.
5. The Court below is directed to release the articles in question seized pursuant to the process issued under Section 83 of the Cr.P.C.
6. With the aforesaid direction, this application is allowed and the order dated 07.03.2022 passed by the learned Addl. District & Sessions Judge-I-cum-Special Judge, Kaimur at Bhabhua in N.D.P.S. Case No. 05 of 2015 arising out of Kuchhila P.S. Case No. 08 of 2015 is hereby quashed. (Sandeep Kumar, J) Shishir/- U T
