JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 The petitioner seeks regular bail in connection with Special (NDPS) Case No. 07/2019, arising out of F. No.NCB/PZU/V/04/2019, registered for offences punishable under Sections 8/20/25/29 of NDPS Act.

Prosecution case is that a truck was intercepted by the officials of Narcotic Bureau and 828 kilograms of ganja has been recovered and the accused persons, who were arrested on the spot disclosed the name of petitioner as the person, at whose instance, they were carrying ganja..

It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner and he has been made accused in this case only on the basis of confession of co-accused and except that there is nothing

Patna High Court CR. MISC. No.71727 of 2019(3) dt.10-01-2020 2/2 against them and he has been in judicial custody since 20.02.2019.

Learned counsel appearing on behalf of Union of India opposed the prayer for bail on the ground that in this case, huge quantity of ganja has been recovered, however, he conceded the fact that name of petitioner has come on the confession of co-accused.

Having heard both sides, in view of the above subnmission, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Patna, in connection with Special (NDPS) Case No. 07/2019, arising out of F. No.NCB/PZU/V/04/2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
