The petitioner apprehends his arrest in Warisaliganj P.S. Case No.49 of 2018 registered under Sections 366, 365 and 34 of the Indian Penal Code.

The mother of the victim alleged that Savitri Devi took her daughter aged about 16 years but she did not return. During the course of search, the informant came to know that the petitioner kidnapped her minor daughter.

The learned counsel for the petitioner submits that victim appeared and made her statement(Annexure-2) under Section 164 Cr.P.C. and she disclosed that she left her house and solemnised marriage with the petitioner. She showed her willingness to live with her husband.

Taking into consideration the fact that victim herself

No.68476 of 2019(2) dt.08-11-2019 2/2 denied the factum of her kidnapping and she disclosed that she voluntarily solemnised marriage with the petitioner and she is living with her husband, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Nawada in connection with Warisaliganj P.S. Case No.49 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
