====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 103(1) and 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the petitioner along with Bittu Kumar stabbed the husband and bhainsur of the informant.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. He further submits that the specific allegation of stabbing is against the coaccused, Bittu Kumar and the post-mortem doctor has found only one injury. It is submitted that the petitioner is in custody

Patna High Court CR. MISC. No.72047 of 2025(3) dt.01-12-2025 2/2 since 24.04.2025 and that the charge-sheet has already been submitted in this case. He further submits that the post-mortem report does not support the prosecution case as only one injury was found and the petitioner claims clean antecedents.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of J.M.-1st Class, East Champaran, Motihari in connection with Chakia P.S. Case No. 198 of 2025.
